
Atomic Guitar Works takes extreme pride in the quality of their guitars and assures that every instrument is crafted with the highest quality materials. Every Atomic Custom Guitar is warrantied for a period of 5 years from original purchase date to the original owner.
Warranty does not apply unless you provide a copy of your original sales receipt.
What We Cover: Atomic Custom Guitars are warrantied to be free from defects in material & workmanship from the date of purchase to the original purchaser when purchased from Atomic Guitar Works. We will repair or replace, at our option, any guitar or part thereof which is found by Atomic Guitar Works to be defective. We also reserve the right to use materials regularly available at the time of the repair in the event that original materials are no longer available. Warranty service requires a copy of the original sales receipt, and MUST be presented at the time of service.
What We Will NOT Cover
1) Any Instrument modified after original shipment from our factory (This includes modifications performed by any other musical instrument repair or retail store).
2) Any instrument that has been altered or modified in any way as to change the serial number.
3) Any instrument that has been damaged due to misuse, neglect or accident.
4) Any instrument that has been subjected to extreme humidity or temperature conditions.
5) The subjective issue of tonal characteristics.
6) Any instrument that has been serviced by unauthorized persons.
7) Shipping damages of any kind.
8) Normal wear and tear (i.e.; worn frets, worn machine heads, worn plating, string replacement, scratched pickguards, damage from accessories (Straps, ect.), or damages to or discoloration of the instrument finish for any reason).
9) Freight charges to and from the factory or authorized dealer for customer owned goods.
10) Claims by anyone other than the registered owner.
How To Obtain Warranty Service
In the event of a legitimate claim, you should notify us by telephone. We will then issue a return authorization and have you ship your guitar to our factory. The owner must ship the guitar, freight and insurance prepaid. No instruments may be returned to Atomic Guitar Works without prior return authorization. Services performed by unauthorized persons will void this warranty. When returning an instrument, a copy of the sales receipt establishing proof and time of purchase MUST be sent with the instrument. Warranty and Legal Disclaimers: Atomic Guitar Works exclusive responsibility shall be as provided under this warranty and, UNDER NO CIRCUMSTANCES, SHALL ATOMIC GUITAR WORKS BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES. THIS LIMITED WARRANTY IS YOUR EXCLUSIVE REMEDY AND IS MADE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED; ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY EXPRESSLY LIMITED IN DURATION TO THE DURATION OF THIS WRITTEN WARRANTY. Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This Warranty gives you specific legal rights, and you may have other rights which vary from state to state. No person, whether or not an agent, is authorized to make or assume any obligations other than those stated in this warranty. ATOMIC GUITAR WORKS OR ATOMIC CUSTOM GUITARS WILL NOT BE LIABLE FOR ANY EXPENSES, CLAIMS, OR SUITS ARISING OUT OF OR RELATING TO ANY OF THE FOREGOING.
ATOMIC GUITAR WORKS POLICIES AND PROCEDURES
PAYMENTS
Payment in full is expected upon completion of work.
property will remain in the sole possession of Atomic Guitar Works until all invoices are paid in full. We will accept partial payments, but we will not relinquish your guitar(s) until all invoice(s) is/are paid in full. We accept Cash. We accept Visa, MasterCard, Discover, and American Express. We accept Debit/Checkcards only with a Visa or Master Card logo. We accept personal and business checks. There is a $25.00 charge on all returned checks. The customer will then be placed on a cash only status. We do not offer "cash back". Refunds will be in the same form as the payment. Cash payments will be refunded by check. Refunds on items purchased by check will be made 10 business days after original transaction. We reserve the right to refuse payment by individuals other than the owner of instrument.
RETURNS
Returns on goods are accepted, provided such goods have not been altered, worn, or damaged. All sales on all goods are final after 30 days. Refunds on goods paid for with Visa, MasterCard, Discover, or American Express will either be issued a credit to the same card used to purchase goods being returned, or issued a Credit Memo, at Atomic Guitar Work’s discretion. Due to the uniquely subjective nature of tone and tonality, returns on electric guitar pickups are only subject to the manufacturer's exchange policy and are not subject to refund. Labor charges for installation of goods are not subject to refund. Due to the uniquely subjective nature of tone and tonality, acoustic pickups of any type are not subject to exchange or refund once installed, in part or whole, upon any instrument.
PAST DUE INVOIVES AND STORAGE FEES
Invoices not paid in full within 28 days after completion of work will be considered past due. On the 29 day after completion of work, the instrument will be assessed a $5 storage fee. An additional $5 will be added to the existing invoice every 7 days until the invoice is paid in full. Property left 60 days past completion of work will be considered abandoned and may be sold in order to recover any costs incurred. Atomic Guitar Works reserves the right to hold any instrument until all past due invoices are paid. This includes "Bounced" checks and disputed card charges. This also pertains to any and all invoice(s) by the same customer.
RUSH AND EMERGENCY SERVICES
We will provide "rush" and "emergency" services on a case by case basis. Instruments requiring completion within 72 hours after customer drop-off will be charged a $20 "rush service" fee. Instruments requiring completion within 24 hours after customer drop-off will be charged a "rush service" fee that will be the equivalent of $50 or 50% of the cost of repairs, not to exceed $100.00 Customer will pay for any and all overnight, 2nd, or 3rd day delivery charges.
DAMAGE TO INSTRUMENTS AND POTENTIAL RISK
Accidental damage caused to instruments while in Atomic Guitar Works possession will either be repaired by Atomic Guitar Works or compensated for in an appropriate and reasonable fashion as agreed upon by both Atomic Guitar Works and owner of such instrument(s). Atomic Guitar Works will insist that you thoroughly inspect your instrument(s) for any damage before you sign the release statement at the bottom of your invoice. Your signature of this release transmits the acceptance that your instrument(s) has/have been returned to you undamaged and unharmed in any way by Atomic Guitar Works. Any alleged damage that has been repaired by any establishment other than Atomic Guitar Works prior to Atomic Guitar Work’s acknowledgement and subsequent resolution will not be considered eligible for compensation in any form. Any work to be performed by Atomic Guitar Works that would be considered irreversible or potentially damaging to the structure, aesthetics, tone, value, or playability of any instrument will require the customer's signature acknowledging that these risks have been conveyed to the customer, that the customer understands these risks, and that any damage or losses incurred as a result of such work will not be the responsibility of Atomic Guitar Works.
SERVICE POLICIES
Limitations and potential problems are brought to customer's attention when invoiced whenever possible. Limitations and potential problems not caught during initial inspection will be brought to the customer's attention via phone or email, and will not be acted upon without costumer's consent. Any work involving a "Basic Set-Up" is allowed further adjustments at no charge for a period of 2 weeks once instrument is relinquished to the customer or agent of customer. If not contacted by customer within 14 days after instrument is relinquished to customer or agent of customer, Atomic Guitar Works will consider all work performed satisfactory to customer and no further adjustments will be performed without additional charges. Adjustments and work will be done to the extent that limitations of the instrument(s) and the laws of physics will allow. Additional charges may be added, with customer permission, to resolve certain limitations of such instrument(s). Work performed that is not satisfactory to customer and is presented to Atomic Guitar Works within 30 days of receipt of instrument by customer or agent of customer will either be corrected by, Atomic Guitar Works, or compensated for in an appropriate and reasonable manner as agreed upon by Atomic Guitar Works and customer considering that no limitations of instrument(s) or physics existed to prevent customer satisfaction. Work that is not satisfactory to customer due to limitations of instrument(s), componentry, or laws of physics will not be compensated for. Instruments that are found to have severe limitations that will not allow a notable improvement will require customer signature approving such work despite customer acknowledgement of such limitations before such work will proceed.
RELINQUISHMENT OF INSTRUMENTS
Unless prior notification has been made, no instrument will be relinquished to anyone other than owner, or known agent of owner. Atomic Guitar Works reserves the right to request picture identification prior to relinquishing instrument(s). Atomic Guitar Works will not relinquish instruments until all invoices regarding such instruments are paid in full.
SCHEDULING
Unless requested, we will not call upon completion of instrument. The "due date" on your invoice is the date when we expect the work on your instrument(s) to be completed. The scheduling of "rush" services is subject to existing workload and schedule. If Atomic Guitar Works misses a "due date" when all necessary information and components were available, we will offer appropriate and reasonable compensation by either reducing invoice total or performing additional customer approved labor.
INVOICING
Invoices reflecting costs for services and goods will be presented to customer upon leaving instrument for such services to be performed. Atomic Guitar Works will contact customer and obtain permission to perform additional services not listed on original invoice should instrument require additional services. Customer is required to sign invoice upon leaving instrument at Atomic Guitar Works acknowledging invoice total, accepting terms of storage fees should they become applicable, and effectively giving permission for Atomic Guitar Works to perform labor itemized in such invoice. Customer is required to sign invoice upon retrieving instrument acknowledging that invoiced work has been performed satisfactorily and that Atomic Guitar Works has caused no damage or harm to instrument(s).
CUSTOMER INFORMATION
Customer information given to Atomic Guitar Works will only be used for contact information purposes by Atomic Guitar Works and will never be sold nor given freely to any person or entity for advertising purposes. No single customer's information will be divulged to any individual or entity without customer consent except where required by law or legal action.
WARRANTY WORK
Atomic Guitar Work’s status as a warranty station for several guitar manufacturers is based on Atomic Guitar Work’s acceptance of these manufacturer's terms and conditions. Atomic Guitar Works is contractually obligated to abide by these terms and conditions. Atomic Guitar Works will not make specific guarantees as to completion times related to warranty service work. The terms and conditions that Atomic Guitar Works is obligated to abide by often result in longer turn-around times during the performance of warranty service related work. This is especially true of warranty service related work that requires return of the instrument to the manufacturer or requires the manufacturer to ship parts to Atomic Guitar Works. Rush and emergency services do not apply to warranty service related work. Shipment of instruments to manufacturers is at the expense of the customer. Warranty contracts do not cover these expenses. When an instrument requires shipment to the manufacturer for warranty repair, Atomic Guitar Works will extend credit to customer in the amount of shipping expenses to be paid by customer upon return of instrument from manufacturer. ALL manufacturers we perform warranty service work for will require proof of original ownership in the form of an invoice or receipt. Such invoice or receipt must include store name, customer name, model name or number, and serial number of instrument. Atomic Guitar Works will not proceed with any warranty service related work until either proof of original ownership is provided, or customer has provided proof of manufacturer's approval for such work.
